TERMS & CONDITIONS

General

Please take time to read these terms and conditions (“Terms”) governing the Tutor Finder Singapore (“TFS”) Site (“Site”). By accessing this Site, you agree to accept, without limitation or criterion, all of the Terms stated herein. If you do not agree to be bound by the Terms, please discontinue your access to this Site immediately and do not use this Site.

TFS may amend the Terms from time to time without prior notice. The amended Terms will be posted on this Site and by accessing this Site after the amended Terms have been posted, you shall be deemed to have accepted and agreed to the bound by the Terms. You are advised to check the Terms each time you visit this Site.

Site Availability and Access Rights

TFS aims to keep the site operational or ‘live’ at all times however the Site may not be continuously available due to maintenance or repairs or due to unforeseen circumstances relating to the hardware that the Site is hosted on, disruption in Internet service or act of God.

TFS may at any time suspend the operation of this Site or any of the content (“Content”) of this Site for any period of time without prior notice, be it for the purpose of Site updating or upgrading or system maintenance.

TFS reserves the rights to deny access to this Site by any person or to block access from a particular internet location without prior notice and without any reasons whatsoever.

The content of this Site and the Site may be modified or withdrawn by TFS at its discretion and at any time without prior notice.

Disclaimer of Warranties and Liability

 The contents of this Site are provided on a ‘as-is’ basis. TFS hereby disclaims all expressed, implied and warranties of any kind to you or any third party, whether arising from the usage or the reference or by the operation of law or otherwise, including but not limited to the following: 

  • any representations or warranties as to the accuracy, completeness, reliability, timeliness, up-datedness relating to the content of this Site; and
  • any representations or warranties that the content and functions that is made available on this Site shall be error-free and shall be available without delay or interruption, or that any defects on this Site shall be rectified, or that this Site and its contents, including all scripts and codes and the server that this Site is hosted on are and will be free of all malicious codes, viruses and other harmful elements.

TFS shall not be liable to you or any third party for any damage or loss whatsoever, including but not limited to direct, indirect, punitive, special or consequential damages, loss of income, data or damage to your computer  and related computer equipment or property, arising directly or indirectly from :

your use of or access to this Site;
any loss of access to or use of this Site, howsoever caused;
any inaccuracy or incompleteness in, or errors or omissions in the transmission of, the Contents;
any delay or interruption in the transmission of the Contents on this Site, whether caused by delay or interruption in transmission over the internet or otherwise; or
any decision made or action taken by you or any third party in reliance upon the Contents, regardless of whether TFS has been advised of the possibility of such damage or loss.

Indemnity

You hereby agree to indemnity TFS and hold TFS harmless from and against all claims, liabilities, cost and expenses (including but not limited to legal costs and expenses on a full indemnity basis) made against or incurred by TFS arising from:

a.     your access and use of this Site or

b.    your breach of any of the Terms stated herein

This Site may contain hyperlinks to websites which are not maintained by TFS. TFS is not responsible for the contents of those websites and do not endorse the views expressed in them. TFS do not have control over and cannot guarantee the accessibility or proper functioning of those websites. TFS will not be liable to you or any third party for any damage or loss whatsoever arising from your access to those websites. Use of the hyperlinks or access to those websites are entirely at your own risk.

Hyperlinks to other websites are provided for your convenience and may be removed or replaced by TFS at its absolute discretion. In no circumstances shall TFS be considered to be associated or affiliated in any manner whatsoever with any trade or service marks, logos or other devices used or appearing on websites to which this Site is hyperlinked.

Hyperlinks to this Site from other websites

  • You shall not cache or frame this Site or any part thereof or any of the Contents, nor create hyperlinks to any page of this Site or any of the Contents, without the prior written permission of TFS and (where relevant) TFS's third party suppliers.
  • By framing or creating hyperlinks to this Site or any of the Contents, you are deemed to have accepted, and to have agreed to be bound by, the Terms stated herein. If you do not accept, or do not agree to be bound by, these Terms, you shall immediately remove all frames of, and hyperlinks to, this Site and its contents.
  • Under no circumstances shall TFS be considered to be associated or affiliated in any manner whatsoever with any trade or service marks, logos, insignia or other devices used or appearing on websites which hyperlink to this Site or any of the Contents.
  • TFS reserves all rights to remove or disable any hyperlinks to or any frames of this Site or the Contents, if those hyperlinks or frames are on websites containing material or information which, in the opinion of TFS, is profane, defamatory, obscene, indecent or otherwise objectionable, or violates any written law or is otherwise unlawful, or is an infringement of TFS's intellectual property or other proprietary rights.
  • TFS reserves the right to remove or disable any unauthorised hyperlinks to or any unauthorised frames of this Site or the Contents, appearing on any other website.

Permission for the use of this Site or its contents

You may only use this Site to make genuine and valid search for home private tuition. You may not use this Site to make any fraudulent, false and exploratory registration and sign-ups. 

You agree to use the Site only for its intended purpose. You must use the Site in compliance with all privacy, data protection, intellectual property, and other applicable laws.

The following uses of the Site are prohibited

You may not attempt to interfere with, harm, reverse engineer, steal from, or gain unauthorized access to the Site, user accounts, or the technology and equipment supporting the Site frame or link to the Site without permission; use data mining, robots, or other data gathering devices on or through the Site; post incomplete, false, or misleading information, impersonate another person, or misrepresent your affiliation with a person or entity; disclose personal information about another person or harass, abuse, or post objectionable material; sell, transfer, or assign any of your rights to use the Site to a third party without our express written consent; post advertising or marketing links or content, except as specifically allowed by these Terms; use the Site in an illegal way or to commit an illegal act in relation to the Site or that otherwise results in fines, penalties, and other liability; or access the Site from a jurisdiction where it is illegal or unauthorized.

In addition to any other rights or remedies that may be available to TFS, without any liability whatsoever, in its sole discretion terminate or restrict your access or use of the Site at any time, with or without notice.

Where permission is required by these Terms of Use for use of this Site or the Contents, you may apply for permission by writing to TFS and include the following information in your correspondence:

  •  the reason(s) why you require the use of this Site or the Contents;
  •  the intended manner of use of this Site or the Contents;
  •  whether it is the whole or part only of this Site or the Contents which you   intend to use, and if part only, which part(s);
  •  where the intended use involves creating hyperlinks or frames of this Site or   the Contents on other websites, the website addresses of all such other   websites; and
  •  the duration of the intended use of this Site or the Contents.

TFS may, at its absolute discretion, grant or refuse permission to use this Site or the Contents, and (if permission is granted) impose such conditions for the use of this Site or the Contents as it deems fit.

TFS shall not be obliged to provide any reasons for its decision.

Governing Law

The Terms stated herein shall be governed by and construed in accordance with the laws of the Republic of Singapore, and you agree to submit to the non-exclusive jurisdiction of the Singapore courts.


SPECIFIC TERMS FOR LEARNERS


 Parent’s/Learner's Registration and Information

  •  All requests are subject to tutor's availability - Whilst TFS makes its recommendation upon a request for tutor, all request is subject to availability of tutor’s acceptance and confirmation. Requesting a tutor made on this Site is considered provisional until a confirmation email/SMS/WhatsApp is provided to parents/learner upon a request of a tutor. 
  • Guideline on tuition rates -  TFS attempts to provide a guideline of tuition rates chart across the board but as it is a free market, TFS considers it a discretion of individual tutor to state his/her rates based on custom-fit learning, the number of years of experience, academic and professional qualifications and proven track records.
  • Disclaimer on learner's grade - TFS does not guarantee or shall not be held responsible for learner's grade improvement or academic success based on the recommendation of tutor from our Site and/or through other means of communication such as SMS/WhatsApp/phone call and email.   Every learner has an ownership to succeed with hard work, effort and consistency in the respective subject or subjects being tutored.  
  • Permission to contact parent/learner - TFS will be given the permission to contact Parents/Learners upon completing of Request for Tutor form whereby TFS shall follow-up with request findings, providing additional information and confirmation of the tutor's assignment.
  • Request for and verification of tutor's credentials and qualifications - TFS adopts the best practices of verifying tutor’s qualifications, proven track record and years of experience during tutor’s registration. However, parents/learners may request to verify the same, in person, on the first day of lesson.   The request must be communicated with TFS so that it will be highlighted to the tutor prior to the first lesson.  

Payment of Agency Commission & Change of Tutor  

  • Referral fee and agency commission - TFS offers a free service to the learner and/or parents. Learners and/or parents will pay the normal tuition fees. We will charge the agency commission of 50% of the first month tuition fees on the tutor.   However, learner/parents are required to expedite the payment of the commission fee to TFS directly, on the tutor's behalf.  An invoice will be issued separately upon confirming a tutor assignment.  The remaining 50% of the tuition is to be paid to the tutor directly at the end of the month.
  • Change of tutor - In the event that the assigned tutor did not meet your expectation, you may change to another tutor at no extra charge. However, if you would like to terminate the assigned tutor’s services during the first month, you must inform us at least 24 hours before the next lesson.  You are required to pay for the lessons that have already been taught prior to termination.  

Best Practices on Tuition Schedule and Cancellation policy

  • Commitment on tuition schedule - It is important to consider your / your child’s schedules and appointments carefully before requesting for any tuition assignments as tutors have other commitments and cancelling their assignment at the last minute is not a fair practice and will deter them from committing to other tuition assignments.
  • Cancellation notice at least 24 hours' in advance - Parent/learner must inform TFS of any cancellation at least 24 hours' prior to the first lesson, on any cancellation/termination notice.  As TFS allows a flexible cancellation policy for parent/learner to terminate a tuition assignment at any time, however, parent/learner is liable pay the tutor based on the number of lessons taught during the first month.  A 50% referral commission to TFS shall still apply based on the pro-rated fees; for any cancellation that will take place within the first month.  The assigned tutor will be paid the remaining 50% from the pro-rated fees.
  • Compensation fee - Parent/learner shall be liable to pay a compensation fee of 100% of the first lesson fee in the event that cancellation notice is made within 24 hours' prior to the first lesson.  Payment of compensation amounting to 50% of the first lesson will be paid directly to the tutor and another 50% will be paid to TFS directly.   An invoice will be sent to learner/parent for payment. 
  • Tutor cancels assignment before first lesson - Tutors are expected to fulfil at least 4 weeks of tuition lessons upon allocation of assignment.  In few cases whereby a tutor cancels an assignment in less than 24 hours' prior to the first lesson, TFS shall place an embargo on the tutor from this Site including but not limited to other affiliates, associates and its partners, unless there is a valid excuse such as a death of a loved one or sickness.  
  • Tutor cancels assignment within first 4 weeks - In the event that a tutor cancels an assignment within the first 4 weeks, learner/parent are only liable to pay 50% of the tuition fees to TFS.  The tutor, in this case, is not entitled to any tuition fees even though lessons have already been conducted and completed.  

 Collection of Payment & Payment Methods

  • Collection of payment - TFS will collect a payment from learner/payment at the end of the second lesson. 
  • Payment methods for agency commission (paid on behalf of tutor) - All payment to TFS is to be paid via ATM fund transfer/online banking or Paypal payment via credit card. The remaining 50% is to be paid directly to the assigned tutor and 100% for subsequent months. An invoice will be sent to you separately.  
  • Payment methods for compensation fee - All payment to TFS is to be paid via ATM fund transfer/online banking or Paypal payment via credit card.   A compensation fee of 50% will be paid to the tutor directly and the remaining 50% is to be paid directly to TFS. We will notify you directly on the payment details for the tutor.  



SPECIFIC TERMS FOR TUTORS


Personal Data and Privacy

TFS, at all times possible, will uphold its due diligence and best practices in privacy policy protection, virus and malicious code prevention and error-free but TFS will not be liable for any indirect, incidental or consequential damages whatsoever (including, without limitation, damages for loss of profits or loss of information) arising from use or inability to use the contents, even if TFS has been informed of the possibility of such damages.

Upon signing up as a tutor you hereby authorise that TFS shall communicate with you via email, phone or SMS/WhatsApp (depending on your preference) detailing the nature of the tuition assignments and recommendation process.

To stop receiving email message and phone calls, please communicate via email, phone or SMS/WhatsApp on your intention to cease receiving message on tuition assignments. For more information, please go to Privacy Policy. 


Signing up as a Tutor

  • Tutor's eligibility - TFS respects every individual tutor in their profession and passion in teaching but we strictly abide in ensuring and maintaining our stand in upholding our pledge to honesty and integrity.   For tutors other than Singapore and Permanent residents, please ensure that you are eligible to work in Singapore before applying within.   
  • Accuracy & validation -  All registered tutors must be at least 18 years of age and a Singaporean/Permanent Resident  and foreign tutors with a valid pass who are eligible to work in Singapore are allowed to register at our Site.    We highly regard the information that you provide to be the most updated, true and accurate as this will impact the recommendation process to our clients.  We encourage all tutors to uphold integrity and honesty to remain true in their profession, tutoring career including but not limited to their representation of information and submission of application.

 Qualifications and Certificates 

  • Collating of qualifications documents and certificates - TFS places a high importance in collating documents and inputs online from tutors with regard to their years of experience, academic and professional qualifications and proven track record as this will speed up the recommendation process and allows TFS to obtain references of your credentials easily.  
  • Review of documents in person - In the event that the learner/parent would like to review tutor’s qualifications in person during the first lesson, tutors will be duly informed about such request and tutors shall be obliged to provide original copies of the essential documentation on the first lesson.


Referral Fee policy

  •  A one-time 50% commission will be deducted from first month's fee from tutor for each successful assignment - Based on industry norm, TFS shall collect a one-time 50% commission of the first month lesson fee for confirmed assignment.   The payment will be collected directly from the learner.   The assigned tutor will collect the remaining fees from the clients directly at the end of the month and to collect 100% of month tuition fees for subsequent months onwards. 
  • Payment Obligations - In the event that a client prefers to pay to the tutor directly, you are obliged to collect it on our behalf and remit the commission fee to us directly either by ATM or online fund transfer, or Paypal via credit card.
  • 50% fees to tutor and 50% commission fee to TFS for early termination by learner - within the first month. Similarly, if the client decides to terminate or discontinue the assignment within the first month, the assigned tutors will be paid 50% of the lesson fees that they have already taught.  TFS will collect the other 50% as commission from the pro-rated fees.
  • A one-time 25% commission will be deducted from first month's fee from tutor for each successful SHORT-TERM assignment.  In view of short-term assignment, i.e up to a maximum of 3 months; TFS shall a collect an equivalent of 25% of the first month lesson fees as part of the referral commission.

Best practices on postponement/cancellation of lessons and tutor’s commitment

  • Tutors' commitment - Tutors must commit at least 4 weeks of lesson.  It is important to consider your schedules and appointments carefully before committing to any tuition assignments as postponing or cancelling, at the last minute or within the first four weeks of lessons, reflects negatively on your commitment and responsibility on your part.  However, we will accept valid reasons such as sickness or death of a loved one.
  • Schedule update - Tutors must inform TFS of any changes in their schedule if they wish to stop receiving assignment updates via email support@tutorfinder.com.sg or phone call/whatsapp +65 8779-2249.
  • Cancellation/termination of assignment within first 4 weeks -  Tutors are required to fulfil at least 4 weeks of assignment failing which,  tutor shall not be entitled to any tuition fee even though lessons have already been conducted and completed.  
  • Before the first lesson - Notice on cancellation of lesson to TFS must be made at least 24 hours prior to lesson.   Tutors must inform TFS of any cancellation at least 24 hours' prior to the first lesson, on any cancellation/termination notice.  Tutors shall be liable to a penalty of 100% of the first lesson fee in the event that cancellation notice is made within 24 hours' prior to the first lesson. However this will be waived with valid reasons.

 Compensation fee 

  • 50% compensation fee to tutor and 50% administration fee to TFS for last minute cancellation -  In cases whereby the learner cancels the assignment in less than 24 hours' prior to the first lesson,  the learner is required to pay a compensation fee of 100% of the first lesson fee of which 50% will be collected by TFS as part of administrative fee and the remaining 50% will be compensated to the assigned tutor.  Compensation fee shall be paid directly from the learner.  
  • Late notice on cancellation and postponement - As TFS allows a flexible cancellation policy for parent/learner to terminate a tuition service at any time, however, parent/learner must allow 24 hours' notice on postponement or cancellation, failing which, learner is liable to pay a compensation fee.
  • Early termination by learner - In the event that the learner terminates the assignment within the first month, learner is liable to pay the tutor based on the number of completed lessons.   Learners must inform both TFS and the assigned tutor. A one-time 50% referral commission to TFS shall still apply based on the pro-rated fees; for any cancellation that take place within the first month. 

 Code of ethics

  • Uphold professionalism - in the aspects of punctuality, by keeping information of learner's progress and work with confidence, by adhering to an appropriate dress code to exemplify respect and dignity for both learner and tutor. 
  • Honesty and integrity - maintaining a flexible approach but respectful manner in assisting learner to discover and work at the best possible outcome to achieve a desire goal.  
  • Respect for learner's culture and background
  • Staying current and adaptable in learner's subjects, syllabus and learning abilities. 
  • Fair practices - As TFS believes in a fair practice and equal opportunity for tutors, we strongly encourage tutors to inform TFS immediately, in the event that the client requests to have extra lessons, other subjects or other siblings by the same tutor.  Similar commission structure shall apply for an additional request for extra lesson, other subjects and other siblings.
